Miami-Dade, FL - Florida State Representative Juan Porras has announced he is considering legislation to repeal homeowner associations, saying he believes these organizations do not align with the state’s values of personal freedom.
Porras shared the proposal on social media, where it received over a million views and sparked debate among residents.
Some homeowners support the idea, citing frustrations with restrictive rules and oversight of minor matters.
Gabby Noreika said her HOA criticized her for unmowed grass during a three-week period of continuous rain, when mowing could have caused damage.
“We should ban HOAs because they focus on small details instead of the real issues,” Noreika told News4Jax.
Other residents and HOA leaders expressed opposition to eliminating associations.
Darnell Jackson said living in an HOA community has advantages, including having a formal body to address neighborhood concerns.
“You have somebody you can go to if there’s a problem or if neighbors are doing something you don’t agree with,” Jackson said.
Scott Lara, president of the Mill Creek at Kendall Town HOA, emphasized that associations help maintain safety, property values, and overall community standards.
He suggested that open communication between residents and management companies could resolve many conflicts without removing HOAs.
“Clear communication is number one,” Lara said, adding that collaboration often addresses issues more effectively than repeal.
No legislation has been formally filed yet.
Lara and other HOA leaders plan to coordinate their responses and provide lawmakers with perspectives on the role of homeowner associations if the bill advances.
